    PROMO CODE TERMS AND CONDITIONS

    • “Promo Code” means a code that must be entered at checkout on online transactions in order to receive a discount or benefit.
    • Each promo code is subject to (a) the specific terms and conditions stated on the promo code offer and (b) these general promo code terms and conditions. In the event of any inconsistency, the former prevails.
    • Not redeemable for cash and cannot be used to purchase gift cards.
    • Valid for qualifying purchases made on Jurlique.com.au.
    • Must be redeemed within the validity period.
    • Not redeemable on gift sets, sets, limited edition items or sale items unless expressly stated otherwise.
    • Cannot be applied to previously placed orders or products not in stock at the time of purchase. No rainchecks.
    • Discounts are applied prior to shipping, handling and sales tax charges.
    • Promo codes cannot be combined with other offers and can only be redeemed once per customer unless otherwise stated.

    VOUCHER TERMS AND CONDITIONS

    • “Voucher” means a voucher that must be presented instore to redeem a specified discount or benefit.  
    • Vouchers (“Vouchers”) are subject to (a) the specific terms and conditions stated on the Voucher; and (b) these general Voucher terms and conditions. In the event of any inconsistency, the former prevails.

    GIFT CARDS TERMS AND CONDITIONS

    • “Gift Card” means an electronic or physical card that has prepaid currency loaded onto it to be spent on Jurlique product in accordance with these terms and conditions.
    • Physical gift cards may be redeemed at Jurlique concepts store in Australia. Online gift cards must be redeemed at jurlique.com.au.
    • The value of the gift card includes GST.
    • Not redeemable for cash and cannot be used to purchase other gift cards or other tender. Cannot be exchanged.
    • Gift cards will expire 12 months from the date of issue, unless expressly stated otherwise.
    • If purchase exceeds the gift card amount, the balance must be paid by other available payment options.
    • Must be redeemed within the validity period.
    • Physical gift cards must be surrendered upon redemption in full.
    • Expired gift cards are not redeemable and gift card amounts will not be refunded or credited when expired.
    • We reserve the right to cancel any gift card for any reason at any time without notice. In such instances we will elect to provide a refund or a replacement gift card.
    • Gift cards are treated like cash. Defaced, mutilated, altered, lost or stolen vouchers will not be replaced, refunded or redeemed.
    • We reserve the right to correct the balance of your gift card if we believe that a clerical or accounting error has occurred.
    • Jurlique does not accept any responsibility for lost gift cards.

    TerraCycle Terms and Conditions

    Jurlique Recycling Program discount available on the return of empty Jurlique packaging at Jurlique boutique stores only. 10% discount applied to one product for each item of empty packaging returned for recycling.     Who is running the competition?  

    The Promoter is Jurlique International Pty Limited (ABN 40 064 901 131), Level 9, 151 Castlereagh St, Sydney, NSW, 2000 Phone: 1800 805 286.

     

    When will the competition start and end?  

    The competition starts at 12.01am (Australian Eastern Daylight Time) on 18 February 2019 and ends at 11.59pm (Australian Eastern Daylight Time) on 10 March 2019 (the Competition Period).

     

    Who can enter?  

    Only Australian residents aged 18 years or over who can take the prize to coincide with the period 23 May 2018 and 27 May 2018 (inclusive) can enter.

     

    Who can't enter?  

    Directors, officers, management and employees of:

    (a)                 the Promoter; or

    (b)                 the agencies or companies associated with this competition,

    and their immediate families, can't enter.

     

    Where will the competition run?  

    The competition will run in Jurlique’s pop up store located at Myer Rundle Mall,  22 Rundle Mall, Adelaide SA 5000, Australia (Store)

     

    Do I need to buy anything to enter?  

    No purchase necessary

    Entry instructions  

    During the Competition Period, visit the Store and fill out the entry form, which includes answering in no more than  words or less "Where is the Jurlique farm located and why you would like to win a farm tour with a friend?" and providing all other requested information.

     

    How many winners will there be and how will they be chosen?  

    This is a game of skill.  On 12 March 2019 a judging panel appointed by the Promoter will review each valid entry and will judge the entries based on creativity and originality to determine the winner.  Chance plays no part in how the winner will be selected.

    The valid entry judged to be the best will win the prize.

    All judging decisions are as determined by the Pro

    moter, in their absolute discretion.

    What can I win?  

    There is 1 prize available.

    The prize is one (1) tour to Jurlique’s Farm located in the Adelaide Hills, South Australia for the winner and one adult companion.  The winner shall be able to choose the day of the tour, provided that such date takes place within the next twelve (12) months after the winner has accepted the prize.

    How many times can I enter?  

    Only 1 entry per person.

     

    How and when will the winners be informed?  

    If you are the winner, you will be informed by phone or email

     

    If I win, when must I claim my prize?  

    You must claim your prize within 30 days after being notified of the win (Australian Eastern Standard Time).

     

    What if I don't claim my prize on time?  

    If the prize has not been accepted or claimed within 30 days of notification of the win, the entry will be discarded and the Promoter reserves the right to re-award the prize to the person who submitted the next best valid entry.

    Any such winner will be informed by phone and/or email.

    Entry

    2                   Your entry must be received during the Competition Period.  Your entry is deemed to be received only when received by the Promoter’s database.  The Promoter is not liable for any problems with communications networks.  You are responsible for your own costs associated with entering.  If you enter using automatically generated entries or multiple aliases you may be disqualified.

    3                   Every entry, including any “25 words or less” statement, must be your original work and not copied.

    4                   The Promoter owns all right and title to your entry (including all copyright in all elements of your entry) and may copy and amend your entry (including the “25 words or less” statement) and may use (or allow others to use) your entry and any rights in relation to your entry, to publicise this competition or for any other purpose.  These rights are perpetual, royalty free, world-wide, irrevocable and transferable.  For example, the Promoter may publish all or any part of your entry or any amended version of it.  The Promoter may also decide not to publish an entry, to cease publication of an entry, or to publish an edited entry.

    5                   You warrant that your entry does not breach any third party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law).  Your entry must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity or language the Promoter deems offensive).

    Prizes

    6                   If you win, your prize will be one (1) guided tour for you and 1 adult companion to Jurlique’s Farm, located in the Adelaide Hills, South Australia. You will be able to choose the date of the tour, subject to such date taking place within the next twelve (12) months after acceptance of the prize. The tour includes:

    6.1                one (1) picnic for two people at Jurlique’s Farm, to be determined by Promoter in its absolute discretion.

    For the avoidance of doubt, the prize does not include flights nor accommodation.

    7                   You and your companion are responsible for all other costs related to the prize, including flights and/or any other means of transport, accommodation, any additional meals, additional transfer costs, insurance (including excesses), in-room charges and additional taxes.  The prize is subject to any additional conditions of the prize supplier/s including any conditions of travel and conditions of entry into the activities (including behaviour requirements and applicable dress codes). Costs for changes made by you (or your companion) to the prize after it has been booked must be paid by you and your companion as applicable.

    8                   If an event or activity included in the prize is abandoned, called off or postponed for any reason, you and your companion forfeit your entitlement to that prize element and you will not be given any cash or alternative tickets as a substitute for attending the event or activity.

    9                   If requested by the Promoter, you and your companion must consent to a full background check prior to being offered the prize to ensure there is nothing in either your/their personal history or in your/their social media accounts that could be deemed damaging if associated with the Promoter's brand.  This could include criminal activity, strong political views, lewd conduct, etc.  Should anything of concern be found, the Promoter reserves the right, in its absolute discretion, to invalidate you and select another winner in accordance with these Terms and Conditions.

    General

    10                 If you are a winner, you (and your companion) agree to take part in all publicity, photography and other promotional activity as the Promoter reasonably requires, without any compensation.  You (and your companion) consent to the Promoter using your names and images in any promotional or advertising activity.

    11                 You and your companion accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities.

    12                 In order to participate in the activity/activities awarded as part of the prize, you and your companion must comply with any applicable conditions (e.g. height, weight, health and fitness requirements).  You must ensure that you and your companion are healthy and fit enough to take the prize.  You and your companion must follow all requirements of the people responsible for managing the relevant activity/ies. 

    13                 You and your companion must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize.  If you or your nominated companion do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.

    14                 If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the prize between 23 May 2018 and 27 May 2018 (inclusive), your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

    15                 You must not:

    (a)             tamper with the entry process;

    (b)             engage in any conduct that may jeopardise the fair and proper conduct of the competition;

    (c)             act in a disruptive, annoying, threatening, abusive or harassing manner;

    (d)             do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

    (e)             breach any law; or

    (f)              behave in a way that is otherwise inappropriate.

    16                 You are responsible for your companion and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or your companion if they breach these conditions, whether or not legally bound by them.

    17                 If you (or your companion), in the opinion of the Promoter, are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion) from participating in any elements of the prize, at its discretion, subject to any necessary approvals by relevant authorities.

    18                 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

    19                 The Promoter’s decision in connection with all aspects of this competition is final.

    20                 Prizes cannot be transferred or exchanged nor redeemed for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable goods and services tax or similar.  The Promoter is not responsible for any change in prize value.  You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approvals by relevant authorities.

    • By accepting or participating in any prize, your companion accepts these Terms and Conditions.

    22                 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants.

    23                 The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

    Liability

    24                 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).

    25                 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).   

    26                 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes.

    27                 The Promoter may communicate or advertise this competition using Facebook or Instagram.  However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.  You provide your information to the Promoter and not to Facebook or Instagram.  You completely release Facebook and Instagram from any and all liability.

    Collection and use of your personal information

    28                 The Promoter may collect your and your companions’ personal information directly or through its agents or contractors.  The Promoter will use your and your companions’ personal information to conduct the competition. The Promoter may disclose your and your companions’ personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or your companions or storing data. This may include disclosures to organisations outside Australia including in places such as Hong Kong, Japan, China, the United States and the United Kingdom.  If you have marked the “opt-in” box on the entry form, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging. The Promoter’s Privacy Policy (see www.jurlique.com.au/privacy-policy) includes information about:

    (i)                  how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

    (ii)                 how to complain about a privacy breach and how the Promoter will deal with such a complaint.
